Although mediation and arbitration are by far the most common alternative methods of solving disputes, they are not the only types of ADR available. Our team can assist you in crafting a method of resolving your dispute that is best suited to your needs. We have a number of tools available that we can use to do this besides mediation and arbitration. These include:

  • Mediation/Arbitration (Med-Arb): A combination procedure where mediation is conducted first followed by an arbitration if the mediation is unsuccessful.

  • Arbitration/Mediation (Arb-Med):  A combination procedure where arbitration is conducted first followed by a mediation conducted prior to revealing the arbitrator’s decision. If the mediation is unsuccessful the binding arbitration decision is imposed.

  • Neutral Evaluation: The parties present a summary of their case to one of our neutrals who renders a non-binding prediction of the outcome or the settlement value of the case.

  • Mini-Trial: The parties present their case to one of our neutral third-parties who makes a non-binding decision in an effort to facilitate settlement.

  • Case Evaluation:  One of our team members provides a written non-binding assessment of the case after a short hearing.

  • Special Master:  A court-appointed attorney, subject to the directions and limitations of his or her appointment, exercises the powers of the court.
